Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and TradeOS LLC, a Missouri limited liability company located at 112 River Oaks Rd, Pevely, MO 63070 (“TradeOS,” “we,” “us”). They govern your access to and use of the TradeOS web dashboard, mobile technician app, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use TradeOS

You must be at least 18 years old and authorized to bind the business you represent. You agree to provide accurate account information and to keep it up to date. You are responsible for all activity under your account and for keeping your credentials secure.

2. Your data

You retain ownership of the data you put into TradeOS — customers, jobs, invoices, pricebook, photos, recordings, and everything else. You grant us a limited license to host, process, transmit, display, and back up that data solely to provide and improve the Service. You represent that you have the right to upload any data you put into TradeOS and that doing so doesn’t violate anyone’s rights or the law.

3. Subscriptions and billing

  • TradeOS is sold as a monthly or annual subscription. Prices are listed on our pricing page and may change with at least 30 days notice.
  • 30-day money-back guarantee. If you cancel within the first 30 days of your initial paid subscription, we will refund 100% of fees paid to date — no questions, no forms. Email support@tradeoperatingsystems.com from the email on your account and we’ll process the refund within one (1) business day. The guarantee applies to your first paid subscription period only and does not extend to renewals.
  • After the 30-day window, fees are billed in advance and are non-refundable except where required by law. If you cancel mid-cycle, the Service remains available through the end of the paid period.
  • You authorize us and our payment processor (Stripe) to charge your payment method on a recurring basis. If a charge fails, we may suspend the Service after notice.
  • You are responsible for any taxes other than taxes on our net income.
  • Usage-based fees (for example, AI voice minutes, SMS messages, and Stripe processing) are billed separately as described in-product.

4. Acceptable use

You agree not to:

  • Use the Service for anything illegal or fraudulent.
  • Send spam, harass recipients, or send SMS or voice messages to people who have not consented to receive them.
  • Reverse engineer, decompile, or attempt to derive source code except to the extent the law forbids that restriction.
  • Resell, sublicense, or use the Service to build a competing product.
  • Upload malware, interfere with other users, or probe or stress-test our infrastructure without written permission.
  • Use the Service to store or transmit protected health information subject to HIPAA, or other categories of data we have not agreed in writing to support.

5. Payments to your customers

Stripe Connect processes payments from your customers to you. Stripe’s Connected Account Agreement applies to that relationship. TradeOS is not a bank and does not hold your funds. Disputes, chargebacks, and refunds between you and your customers are your responsibility, though we’ll help where we reasonably can.

6. AI features

TradeOS uses third-party models (including Retell AI and OpenAI) to power the AI voice receptionist, call summaries, and voice-to-text invoicing. AI output may be inaccurate or incomplete — you’re responsible for reviewing invoices, job details, and any automated communication before it goes out. The AI receptionist is a tool, not a substitute for professional judgment.

7. SMS messaging program

By providing a mobile number to a contractor using TradeOS, customers consent to receive SMS messages related to their service request, including appointment confirmations, technician arrival updates, invoices, payment links, and reminders.

  • Program: TradeOS Service Notifications
  • Message frequency: Recurring; varies by job activity (typically 2–10 messages per job)
  • Cost: TradeOS does not charge recipients for SMS messages. Message and data rates may apply per your carrier.
  • Opt out: Reply STOP to any message
  • Help: Reply HELP or contact support@tradeoperatingsystems.com
  • Supported carriers: AT&T, Verizon, T-Mobile, Sprint, US Cellular, and other major US carriers. Carriers are not liable for delayed or undelivered messages.
  • Privacy: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Mobile opt-in data is used solely to deliver the messages you have consented to receive and to operate the Service. TradeOS LLC does not sell SMS data. 8. Third-party integrations

TradeOS integrates with services like QuickBooks Online, Stripe, Retell, and OpenAI. Your use of those services is governed by their own terms. We are not responsible for third-party services and do not guarantee their availability. If a third-party service changes or goes away, we may modify or remove the related TradeOS feature.

9. Availability

We work hard to keep TradeOS up and fast, but we don’t guarantee the Service will be uninterrupted or error-free. Maintenance, outages, and changes to features are a normal part of running software. We will use reasonable efforts to give notice of planned downtime.

10. Suspension and termination

You may cancel at any time from your account settings. We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that creates risk for us, our vendors, or other users. On termination, we will give you a reasonable window to export your data before deletion.

11. Warranty disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements or be error-free.

12. Limitation of liability

To the maximum extent permitted by law, TradeOS and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the 12 months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless TradeOS and its affiliates from any claim or demand, including reasonable attorneys’ fees, arising out of your data, your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in St. Louis County, Missouri, and you consent to personal jurisdiction there.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the update.
